Why is there a consultation happening on the Conflict of Interest Act?
Section 36 of the Conflict of Interest Act directs the Commissioner to review the Act and its administration following every general election. The results of the review and any recommendations for changes are reported by the Commissioner to the Standing Committee on Legislative Assembly Management within 18 months following the general election.
Included in the review is an opportunity for the public to make written submissions on the Act to the Commissioner.
What is the Conflict of Interest Act?
The Conflict of Interest Act provides a framework to help Members of the Legislative Assembly balance the duties of elected office with their interests as a private citizen.
In general, the Act provides guidance to Members and to the public to ensure Members don’t participate in decisions, or share knowledge, they know would provide direct personal financial benefit to themselves or to others.
How does the Act work?
The Act outlines the responsibilities of Members once they are elected to the legislature and appoints a Commissioner to provide advice upon request and to assist the Members in fulfilling their responsibilities under the Act.
The Act also authorizes the Commissioner to investigate situations where a Member has allegedly failed the responsibilities outlined in the Act, when a formal request is made in writing to the Commissioner's office.
